The Tagansky District Court of Moscow has ruled unlawful the publication of a job vacancy containing a requirement by the employer to hire "Slavs only". The court held that such a condition violates the principles of equality and the prohibition of discrimination enshrined in the Constitution of the Russian Federation and the Labor Code.
According to the case materials, a job posting titled "Baking Pancakes (Shift Work with Accommodation)" was published on a job listings website. One of the requirements for applicants stated "must be Slavic".
The court determined that this restriction bears no relation to the candidate's professional qualifications and thus contravenes labor legislation. The court's decision cited:
"No one may be limited in labor rights and freedoms or receive any advantages depending on sex, race, skin color, nationality, language, or other circumstances not related to the business qualities of the worker."
The court also referred to the Constitution of the Russian Federation, provisions of the Labor Code, and Federal Law No. 114-FZ of July 25, 2002 "On Countering Extremist Activity", as the publication of such advertisements may be regarded as an act of extremist discrimination.
This is not the first instance where Moscow courts have prohibited job postings specifying nationality. Similar rulings have previously been issued regarding vacancies for builders, nannies, and cooks marked "Slavs only".
Administrative liability is provided for the dissemination of discriminatory job vacancies:
for individuals — fines from RUB 1,000 to 3,000;
for legal entities — from RUB 50,000 to 100,000 (Article 13.11.1 of the Code of Administrative Offences of the Russian Federation).
